Understanding Your Loan Terms - What You’re Really Signing
Insights, advice, and stories from Barko.
Before you sign any credit agreement, it is important to understand exactly what you are agreeing to. A loan is a legal contract. That means every word matters.
Knowing the basic loan terms helps you make informed decisions, avoid confusion, and understand your rights as a borrower. The difference is that Barko Loans believes informed borrowers make better financial decisions.
Let’s break down the most important loan terms
The Lender — the credit provider providing the loan. In this case, that is Barko.
The Potential Client — the individual who is applying for a loan.
The Borrower — the individual who has entered into a credit agreement with Barko.
A Short-Term Personal Loan — a loan taken out by an individual for personal expenses, from home repairs to school fees. The loan amount may not exceed R8 000 and must be repaid within 6 months.
What Barko charges
Interest — the cost of borrowing money. Under the National Credit Act, interest rates are capped to protect you from being overcharged:
- First short-term loan in a calendar year: maximum 5% per month.
- Any further short-term loans in the same calendar year: maximum 3% per month.
Initiation fee — a once-off fee charged when your loan is set up. It is capped at R165 plus 10% of the loan amount above R1 000, with a maximum of R1 050 (excluding VAT).
Monthly service fee — a fee charged every month to maintain your loan account. It is capped at R60 per month, excluding VAT.
Credit insurance — cover that pays your outstanding loan balance if you die, become disabled, or are retrenched. The standard premium is capped at R4.50 per R1 000 of your outstanding loan amount. You may also choose optional additional cover at R1.00 per R1 000. This cover is optional. You also have the right to use your own existing credit insurance policy instead of Barko’s, as long as it provides the same minimum cover.
Affordability assessment
Before any loan is approved, Barko is required by law to check that you can afford the repayment of your loans. This assessment looks at your income, your monthly living expenses, and any existing debts you already have. The goal is to make sure you are not taking on more debt than you can manage.
Your quote and your agreement
Before you sign anything, Barko must give you a Pre-Agreement Statement and Quotation. This document sets out the loan amount, all fees, the interest rate, the insurance premium, and your repayment amount, so you know the full cost upfront. You can accept or decline the quote. There is no obligation to proceed.
If you accept, a Credit Agreement will be signed between you and Barko. This agreement sets out all the terms and conditions of your loan, including how much you owe, when payments are due, and what happens if you miss a payment.
Barko is required to give you a copy of your Pre-Agreement Statement and Quotation, your Credit Agreement, and your credit insurance policy within a reasonable time after signing. Barko sends this to you via SMS right after your loan was issued to you.
All terms and conditions in your agreement are regulated under the National Credit Act. No credit provider is allowed to include terms that go against the Act, and you cannot be asked to sign away any right that the Act gives you.
